Парламентарії запропонували усунути законодавчі колізії та прогалини в законі про нотаріат
У парламенті зареєстровано проект закону № 3031 «Про внесення змін до Закону України «Про нотаріат» (щодо усунення законодавчих колізій та прогалин)» авторства народних депутатів Д.Сторожука і П.Пінзенника.
Як пояснюють автори законопроекту, його метою є поліпшення рівня законодавчої техніки, уніфікація термінології, врегулювання вже усталених відносин через заміни застарілих назв і термінів, передбачення механізмів реалізації окремих повноважень і вчинення нотаріальних дій.
Даний законопроект приводить у відповідність Закону України «Про нотаріат»до реалій практики вчинення нотаріальних дій та Цивільного кодексу України. Зокрема:
• усуває застарілу термінологію;
• деталізує процедуру визначення місця проживання для окремих осіб (малолітні, недієздатні)
• уточнює перелік осіб, які на сьогодні вже здійснюють відповідні нотаріальні дії;
• передбачає вже існуюче право нотаріуса з державної реєстрації тощо.
